NALP, the voice of 100,000 landscape and lawn care industry professionals, is encouraging lawmakers to pass three bills.
The National Association of Landscape Professionals is hosting their annual Legislative Days from July 19-21. On July 21, landscape industry companies are encouraged to meet with or tweet to their senators and representatives to urge lawmakers to pass three pieces of legislation before Congress' summer adjournment, which begins July 30.
H.R. 863: Simplifying Technical Aspects Regarding Seasonal Act of 2015, or STARS Act
Currently, the Internal Revenue Code defines seasonal employees as ordinary employees who are employed in a position for which the customary annual employment is not more than 6 months, and which requires performing labor or services that are ordinarily performed in certain seasons.
The STARS Act seeks to exempt seasonal employees from this definition of "full-time employee" to reduce the administrative burden for small businesses, especially those with highly seasonal workforces, that could otherwise be penalized under the Affordable Care Act.
S. 1140: Waters of the United States Rule
The rule released in May by the EPA and US Army Corps of Engineers remains highly controversial due to the new definitions and standards set forth. S. 1140 is intended to revise these controversial definitions to ensure that the waters protected under the Clean Water Act are more precisely defined, predictably determined, and easier for the industry to understand.
S.1500: Sensible Environmental Protection Act of 2015
The reintroduction of this act aims to revise a 2009 federal court decision in National Cotton Council v. EPA. This decision requires permits from pesticide applicators who spray over navigable waters as defined by the Clean Water Act. Passage of this bill would remove problems for states and pesticide applicators, and reinforce the regulatory standards on labels of crop protection, resource and public health protection products.
NALP asks members to urge their representatives and senators to pass these bills before sessions are adjourned for the summer holiday. Companies who are not attending Legislative Days can write to, call, or tweet to their representatives.
