ASI Financial Services, a leading Level 1 BBBEE Intermediary in the Financial Services Industry, has a position available for a Legal Adviser in its Property Management division. The successful candidate will form part of greater Shared Services Department.
You will be expected to think strategically and contribute towards the holistic development of the team.
ROLES AND DUTIES:
Legal Documents:
Drafting of an array of legal documentation such as letters of demands, non-disclosure agreements, offer to purchase letters, purchase and sale agreements, Service Level Agreements, Lease Agreements and other commercial agreements;
Vetting of all legal agreements received from third parties, providers and clients;
Assist with a range of other contracts and legal issues that may arise across the business including data protection, labour law relations etc.
Legal Advice:
Advise and assist on a range of property management transactions such as Residential and Commercial transactions and in general, commercial and legal structuring;
Support in addressing, resolving and managing legal issues;
Identify key legal risks, research issues and formulate strategies to mitigate exposures;
Prepare legal opinions, as and when necessary;
Monitor, research and understand relevant legislative changes and case law affecting Mainstream's business and the Property Management Sector including regulatory matters;
Provide ongoing and ad hoc legal advice in a variety of legal topics (e.g., Property Law, Company law, Contract Law, litigation, etc).
Litigation:
Residential and commercial property collections;
Receive / issue, address, manage and appropriately defend (as necessary) contractual claims and disputes with third parties (e.g., tenants, landlords, Bodies Corporate, Homeowners Associations, service providers, contractors, clients etc);
Support business in initiating or defending legal action against the business, including reviewing / managing progress of litigation and liaising with external legal and other advisors.
Other Support:
As required, engage with both external and internal legal/advisory resources;
Ad hoc support for all companies under the ASI verticals;
Identify opportunities for new business and growth so as to communicate same to management, specifically in the Property Sector;
Legal Administration;
Legal Risk Management and Mitigation;
Strategic and operational development of a legal firm;
You will be required to also obtain exposure to other parts of the greater company group such as Insurance, Employee Benefits, Investments and Regulatory Compliance.
SKILLS, QUALIFICATION AND EXPERIENCE REQUIRED:
B.Com(Law), LLB or analogous international qualification;
Recently admitted attorney or advocate, registered with the LPC;
Excellent commercial drafting and negotiation skills and experience;
Good commercial acumen, Property Law and Business law experience;
Excellent computer literacy;
Excellent oral and written communication skills;
Ability to work independently;
Detail oriented;
Good people and conflict resolution skills;
Ability to work under strict deadlines and pressure.
