The Kipushi Project S.A. is looking for a Commercial Manager The Kipushi Project, in the DRC's province of Haut-Katanga and southeast of the company's Kamoa discovery, is adjacent to the town of Kipushi and approximately 30 kilometers southwest of the provincial capital of Lubumbashi. Ivanhoe Mines acquired its 68% interest in the Kipushi Project in November 2011; the balance of 32% is held by the DRC's state-owned mining company, Gécamines. The Kipushi Project is based on the high-grade, underground zinc-copper mine in the Central African Copperbelt, which mined approximately 60 million tonnes grading 11% zinc and 7% copper between 1924 and 1993. In addition to producing copper and zinc, the mine produced 12,673 tonnes of lead and approximately 278 tonnes of germanium between 1956 and 1978. Play your part in our team succeeding... The Commercial Manager ensures a high level of support service to internal departments for contract and tender document drafting, tender reviews, negotiating, preparation, administration, procurement and applying an ethical, efficient, risk-managed, consistent and cost-effective approach at every stage of the process.
You will have the following: Law degree (with technical knowledge and experience with FIDIC contracts)Quantity Surveying (with contract law knowledge and experience with FIDIC contracts)5 – 10 years' experience in Contract Administration/Management capacity in the building, construction or mining sectorsYou will have advanced skills and knowledge in: Contract draftingCompiling construction claimsAnalyzing BOQ rates and quantum submissions of claimsApplication of SANS 1200Administrating the commercial aspects of construction contractsDrafting legal correspondenceTo be fully versed and competent in FIDIC and NEC construction contracts and the administration thereofPersonal Competencies should include: Reflects high degree of independent and creative judgment applied to the highest-level goals and objectives of the Company.Reflects significant technical knowledge of process-based projects/interface management.Good background and expertise in EPCM projects in an international environment specifically on mining type of Project.Good knowledge of engineering/construction industry practices, procedures, and work practices.Strong skills in contracts management, administration and negotiation of change orders/claims.Experience in the mentoring and development of Congolese staff within the contracts team.Sound understanding of relevant business, legal system, company law, immigration, manpower, tax, importation, and mining regulations.Well-developed computer skills to be able to implement and maintain effective processes and procedures.Strong analytical capabilities and negotiating skills, sound business sense, advanced English language documentation skills with high attention to detail.Your Key Performance Activities will include but are not limited to: Coach and inform resources of best practice methods.Compliance, Governance and Assurance - Assess, audit and ensure compliance with all statutory requirements.Advise on contract strategies before a request for tender documentation is compiled.Review and comment on tender documentation.Advise on tender qualifications.Identify risks and contract shortcomings and develop contractual particulars and enquiry documents accordingly.Attend monthly commercial meetings on site with site contractors and EPCM contractor.Review and comment on contract agreements.Attend and finalize contract negotiations (where required).Administer EPCM contract (draft contractual letters, ensure contractual requirements are monitored etc.).Review and agree on Guarantee wording.General commercial and contractual assistance and advice on both EOCM managed contracts as well as Client managed contracts.Review and advise on claim strategies and contractual correspondence.Assist with Weekly, Monthly, Quarterly and Annual reports.Set good personal examples on safety and health issues.Draft ad-hoc bespoke contracts for scope outside of the FIDIC suite.Provide general legal advice to the project team.Assist with any arbitration or litigation processes.The finer details: When applying, please submit a PDF version of your CV together with certified copies (certification within a 3-month period) of your ID/passport, driver's license and qualifications.
