Main purpose of position:
Currently we are looking for a Legal Counsel - EPC and O&M in Cape Town, South Africa to be part of our global team working together towards our vision – Improving our future. As our Legal Counsel you will provide legal support on all EPC (Engineering, Procurement and Construction) and O&M (Operation and Maintenance) related legal and contractual matters within the Renewable Energy Sector.
Main responsibilities:

Draft and negotiate EPC/subcontracts and O&M agreements (as required) related to renewable energy projects – solar, hydro, wind, P2X.
Draft and negotiate equipment supply contracts related to renewable energy projects – solar, hydro, wind, P2X.
Draft and negotiate direct agreements and performance security related to EPC/subcontracts, equipment supply contracts and O&M agreements.
Review financing loan documentation re: EPC & O&M terms.
Lead Compliance with regards to forced labour concerns within Scatec's supply chain and develop compliance language in EPC/subcontracts, equipment supply contracts and O&M agreements.
Review supplier IDDs and ensure concerns raised in TEAR reports are covered in equipment supply contracts.
Ensure that compliance risks are properly managed in EPC/subcontracts, equipment supply contracts and O&M agreements.
Serve as legal rep re: all arbitrations involving EPC/subcontracts, equipment supply contracts and O&M agreements.
Liaise with "Regional Legal BD" re: EPC and O&M CPs required for financing.
Advise and support "VP Legal – O&M" and "Contracts and Claims Manager" in the drafting of all contractual notices for variations, claims and/or disputes.
Advise and support Supply Chain in the drafting and managing of claims against equipment suppliers (e.g. delay and/or performance LDs, defect and/or serial defect claims and Force Majeure claims).
Liaise and manage relationships with external legal counsels and legal counterparts at partners, suppliers, subcontractors, project's lenders (as applicable).
Own all legal templates relating to EPC/subcontracts, equipment supply contracts and O&M agreements.

Qualifications and competencies:

Law degree with a focus on common law.
Minimum 3-5 years' relevant work experience – either law firm or in-house counsel.
Commercial drafting experience and reviewing of documents experience.
Must have experience with EPC and O&M Contracts within the renewable energy sector.
Excellent English skills, both written and verbal. Additional languages considered an advantage.
