POSITION : LEGAL/CONTRACTS ADVISOR LOCATION/REGION : HEAD OFFICE (ROODEPOORT) APPLICATIONS: ****** SUMMARY OF KEY RESPONSIBILITIES: Responsible for reviewing, analyzing and administrating construction contracts from the pre-contract to the final stages.
Ensures parties employ due diligence to comply with the terms, conditions, rights, and obligations of the contract.
Performance obligations specified in the contract are being met.
Coordinate any changes to the agreement that might occur over the course of the contract and perform the closeout process when both parties have met their obligations.
REQUIRED MINIMUM EDUCATION / QUALIFICATIONS AND WORK EXPERIENCE: Minimum Education LLB Degree Additional Qualifications Well versed on all suites of construction contract packages e.g., NEC, Fidic, GCC and bespoke EPC contracts Minimum Work Experience At least five years proven work experience in Construction Law SUMMARY OF RESPONSIBILITIES: Review proposed construction contracts at tender/inception stage to identify potentials risk and provide mitigations and/or alternatives.
Assist with negotiations, meetings, or teleconferences between all stakeholders during the negotiation phase of new agreements.
During negotiation phase co-ordinate and assist internal departments with documentation reviews and consolidation of all risk identified.
Draft, review, and negotiate potential Subcontract and Supplier Agreements.
Provide legal/contractual advice input with regards to contractual notices and claims Assist with the preparation and review of contractual notices and claim submitted.
Provide input together with external legal counsel regarding disputes etc.
Ensure compliance with internal and group legal and commercial procedures and policies, including documentation management.
Identify and minimize potential commercial risks with current agreements – supplier, customer/employer, and subcontractor.
Ensure client satisfaction by adhering to turnaround times and ensuring speedy delivery of legal/contractual/commercial services.
Co-ordinating of Record keeping.
Co-ordinating and record keeping of the process from the request to a new agreement, until finalised and signed.
Ensure maintenance of contractual records and documentation.
