Commercial Officer Position Concor Construction Pty Ltd invites suitably qualified candidates to apply for the position of Commercial Officer to join our projects across Southern Africa.
The successful incumbent will report directly to the Commercial Manager.
The successful incumbent will be responsible for vetting and approving the terms and conditions of any tenders/proposals submitted by the estimating department, and assessing project viability; coordinating with company leadership to conduct risk assessments and resolving contractual and commercial negotiations, claims, and disputes.
Preference will be given to Employment Equity candidates including disabled applicants.
Duties & Responsibilities The successful candidate will be responsible for (but not limited to): Provide commercial support to sites from award to final account stage; assist in ensuring that contractual opportunities, entitlements, and obligations are being recognised and managed correctly.
Assist in the management of any contractual disputes that may arise.
Preparation and negotiation of Joint Venture, Consortium, and Subcontract agreements where necessary.
Identify risks and ensure that the necessary steps are taken to mitigate and/or resolve risk.
Analyse and report on claims in dispute and prepare for arbitration and litigation where necessary.
Draft policies to ensure that the necessary procedures and adherence to legislative guidelines are maintained.
Provide guidance, assistance, and consultation to management regarding legal compliance.
Remain up to date on all construction legislation and any new legislation in the industry.
Ensure compliance with group policies & procedures.
Minimum Qualifications BSc.
Engineering, Quantity Surveying or Construction Management degree or related field.
A post-graduate qualification in a related field would be an advantage.
Experience A minimum of 5 years construction-related experience, preferably in Roads & Earthworks and/or large civil engineering projects, with a strong commercial focus.
Experience in arbitration, adjudication, and other forms of dispute resolution.
Experience in negotiation of commercial agreements.
Experience in a contracting business environment, such as construction or mining, would be an advantage.
Knowledge and Skills Knowledge of laws, regulations, and concepts applicable to contract preparation, negotiation, and administration.
Working knowledge of construction contracts (FIDIC, GCCC, NEC).
It would be an added advantage to have working knowledge of standard specifications such as SANS, COLTO etc.
Ability to provide advice (orally and in writing) and influence decision making.
Strong interpersonal and communication skills.
Strong analytical and problem-solving skills.
